Terms of Use

• What you make is yoursYou own your prompts and, as far as the law allows, the images and videos you create.

1. Using Whimsy

Whimsy creates images and short videos using AI models provided through Oxen.ai, a third-party AI service, and its partners. You must be at least 13 years old, and if you’re under 18, you need a parent or guardian’s permission. You’re responsible for how you use the app and what you create with it.

These terms work alongside Apple’s Standard End User License Agreement.

2. Your content

You keep ownership of the prompts and media you put into Whimsy, and, to the extent the law allows, of the images and videos you create. You give Oxen.ai and its AI partners permission to process your content only as needed to create your work and check it for safety.

Only add photos, videos or audio you have the right to use. If they show other people, make sure you have their permission.

AI is unpredictable. Results may be inaccurate, unexpected, or similar to what others create, and some ideas may not be protectable by copyright where you live.

3. What you can’t create

Don’t use Whimsy to create or try to create:

• anything that sexualizes or exploits minors, in any way;
• sexual or explicit content, or graphic violence and gore;
• content that harasses, threatens, or promotes hatred against people;
• realistic depictions of real people meant to deceive, or anything made to impersonate someone without their consent;
• content that encourages self-harm, or that is illegal or infringes someone else’s rights.

Every request is checked for safety, and some will be declined. Don’t try to get around these checks. If you see a result that breaks these rules, please report it from the app or email us.

4. Credits and purchases

• Creating uses credits. The price is shown before you create.
• Credits never expire. If a creation fails, its credits are returned automatically.
• Credits have no cash value, can’t be transferred or exchanged for money, and can only be used in Whimsy.
• Purchases are made through the App Store and handled by Apple. Refunds are handled by Apple under its policies.
• Memberships renew automatically each month and add their credits at each renewal, until you cancel. You can cancel anytime in Settings → Apple Account → Subscriptions, at least 24 hours before the renewal date.

Your gallery and balance are kept on your device (and your balance in your iCloud, if you use it). We don’t have accounts, so we can’t restore creations you delete. Use “Restore Purchases” to recover memberships.

5. Changes and availability

We may improve, change or replace the models and options in Whimsy, and we may change prices for future purchases. We may suspend Whimsy, or stop serving requests that break these terms.

6. No warranties

Whimsy is provided “as is” and “as available”. To the extent the law allows, we make no warranties that it will be uninterrupted, error-free, or that results will meet your expectations.

7. Limitation of liability

To the extent the law allows, we won’t be liable for indirect, incidental or consequential damages, or for lost data or profits. Our total liability for any claim about Whimsy is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you.

8. Changes to these terms

If we update these terms, we’ll change the date on this page. Continuing to use Whimsy after that means you accept the new terms.
